Terms of service
These terms govern use of VerifyBG, operated by Bitola Industries Pvt Ltd. By creating an account you agree to them.
What this service is
VerifyBG runs automated background checks against connected data sources, with the subject's consent, and returns a report. It is a reporting tool. It does not make decisions for you and it does not certify that any person is trustworthy.
Your obligations as a requester
- You must have a legitimate purpose for every check you raise.
- You must not raise a check on someone without intending to obtain their genuine consent.
- You must not use this service to stalk, harass, intimidate or discriminate against anyone.
- You are responsible for the accuracy of the details you enter about a subject.
- You must not share a report beyond the purpose it was obtained for.
Consent is not optional
Every check requires the subject to sign consent. Attempting to circumvent this, including by signing on a subject's behalf, is a breach of these terms and may be an offence under the DPDP Act, 2023. We may suspend any account we believe is doing this.
Accuracy and limits of the report
Our reports reflect what connected data sources return at the time of the check. Indian court and criminal record data is matched by name and available identifiers and can produce false matches, particularly on common names. Confidence scores indicate how well a record matched the subject's details; they are not a determination of guilt, identity or character.
You must not treat a flagged item as established fact. Confirm it with the source authority before acting on it. Where a check shows as not available, it means no data source was connected for that check, not that the subject is clear.
Decisions you make
Any decision to hire, rent to, marry, contract with or refuse anyone is yours alone. We are not liable for decisions taken on the basis of a report, and we do not warrant that a report is complete or free of error.
Payment
Checks are priced per report as shown on the pricing section, exclusive of GST which is charged additionally at the applicable rate. Because a check consumes third-party data source calls the moment it runs, completed checks are not refundable. If a check fails for a reason on our side, contact us and we will make it right.
Suspension
We may suspend an account that breaches these terms, particularly around consent or misuse of reports. A suspended account cannot sign in or take any action, and the reason is recorded. Suspension does not delete your data. If you believe a suspension is mistaken, write to our contact page.
Changes
We may update these terms. Material changes will be reflected in the date at the top of this page.
